The Agricultural Land Reserve offers space, privacy, and the appeal of rural living, but it also comes with some of the province\u2019s most restrictive land-use rules.<\/p>\n<p data-start=\"714\" data-end=\"901\">At Revere Homes, we\u2019ve helped clients across Langley, Chilliwack, and the Sea-to-Sky navigate these rules and still create homes they love. Here\u2019s what you should know before you start.<\/p>\n<h3 data-start=\"903\" data-end=\"925\">What Is the ALR?<\/h3>\n<p data-start=\"926\" data-end=\"1192\">The Agricultural Land Reserve was created in 1973 to protect BC\u2019s farmland from being lost to development. It\u2019s managed by the <a href=\"https:\/\/www.alc.gov.bc.ca\">Agricultural Land Commission (ALC)<\/a> and covers over five million hectares, with much of it in the Lower Mainland and the Fraser Valley.<\/p>\n<p data-start=\"1194\" data-end=\"1354\">Regulations have changed over time, with some major updates in 2020. These days, the rules around what you can build are more detailed than ever. For example:<\/p>\n<ul data-start=\"1355\" data-end=\"1777\">\n<li data-start=\"1355\" data-end=\"1409\">\n<p data-start=\"1357\" data-end=\"1409\">Primary homes are capped at 500 m\u00b2 (5,382 sq. ft.)<\/p>\n<\/li>\n<li data-start=\"1410\" data-end=\"1653\">\n<p data-start=\"1412\" data-end=\"1653\">One attached secondary suite is allowed, plus one detached unit (garden suite, carriage house, or manufactured home) up to 90 m\u00b2 (970 sq. ft.) on properties under 40 hectares, and up to 186 m\u00b2 (2,000 sq. ft.) on properties over 40 hectares<\/p>\n<\/li>\n<li data-start=\"1654\" data-end=\"1777\">\n<p data-start=\"1656\" data-end=\"1777\">Secondary units can now be rented out or used for farm help or extended family; no \u201cimmediate family only\u201d restriction<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"1779\" data-end=\"1890\">The ALC sets these allowances but municipalities can add their own rules, and sometimes those are stricter. This layered approach to policy and legislation can be very confusing, even for the people who work for the ALC themselves. So don&#8217;t feel bad if you&#8217;re having trouble making sense of it. You are not alone.<\/p>\n<h3 data-start=\"1892\" data-end=\"1918\">Who Makes the Rules?<\/h3>\n<p data-start=\"1919\" data-end=\"1969\">Building on ALR land is regulated at two levels:<\/p>\n<ul data-start=\"1970\" data-end=\"2112\">\n<li data-start=\"1970\" data-end=\"2040\">\n<p data-start=\"1972\" data-end=\"2040\">The ALC controls what\u2019s allowed in the reserve, province-wide.<\/p>\n<\/li>\n<li data-start=\"2041\" data-end=\"2112\">\n<p data-start=\"2043\" data-end=\"2112\">Your municipality controls zoning, siting, design, and permits.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"2114\" data-end=\"2250\">It\u2019s possible for the ALC to allow something your municipality won\u2019t approve. Larger builds require proving they support active farming and getting a <a href=\"https:\/\/www.alc.gov.bc.ca\/assets\/alc\/assets\/legislation-and-regulation\/policies\/alc_policy_l-26_-_non-adhering_residential_use_applications.pdf\">Non-Adhering Residential Use Permit<\/a> from the ALC.<\/p>\n<p data-start=\"3054\" data-end=\"3238\"><strong data-start=\"3054\" data-end=\"3082\">Do I need to be farming?<\/strong><br data-start=\"3082\" data-end=\"3085\" \/>Not necessarily, but your home has to be \u201caccessory to farm use,\u201d meaning it should support the land\u2019s agricultural potential, even if you\u2019re not farming now.<\/p>\n<p data-start=\"3240\" data-end=\"3478\"><strong data-start=\"3240\" data-end=\"3274\">Can I build a second dwelling?<\/strong><br data-start=\"3274\" data-end=\"3277\" \/>Yes, in most cases. The ALC allows one suite inside the main home and one small detached dwelling. These can be used for rental income, farm help, or family. Your municipality\u2019s zoning still applies.<\/p>\n<p data-start=\"3480\" data-end=\"3657\"><strong data-start=\"3480\" data-end=\"3502\">Where can I build?<\/strong><br data-start=\"3502\" data-end=\"3505\" \/>You\u2019ll usually need to build in a way that protects farmland. This can be a little vague, but often things like building near existing roads, avoiding prime soil, and leaving areas open for agriculture are what the ALC will require.<\/p>\n<p data-start=\"3659\" data-end=\"3775\"><strong data-start=\"3659\" data-end=\"3689\">Will I have full services?<\/strong><br data-start=\"3689\" data-end=\"3692\" \/>Not always. Many ALR properties need septic systems, wells, or private utilities.<\/p>\n<p data-start=\"3777\" data-end=\"3922\"><strong data-start=\"3777\" data-end=\"3806\">What permits will I need?<\/strong><br data-start=\"3806\" data-end=\"3809\" \/>Municipal building permits for sure, and sometimes ALC approval if your plans fall outside standard allowances.<\/p>\n<h3 data-start=\"3924\" data-end=\"3966\">Thinking About Building on ALR Land?<\/h3>\n<p data-start=\"3967\" data-end=\"4196\">Whether you\u2019re creating a rural family home or adding a rental unit, the ALR\u2019s overlapping rules can make it complicated.
